INPI: New Rules for Transfers of Ownership of Trademarks, Patents and Industrial Designs
On May 29, 2026, Resolution No. 162/2026 of the Argentine National Institute of Industrial Property (INPI) was published, approving a new regulation for the recordal of transfers of ownership and changes of business activity before the INPI.
The new regulation applies to trademarks, invention patents, utility models, and industrial models or designs, whether registered or pending.
What changes does Resolution No. 162/2026 introduce?
The new regime introduces several simplifications to the previous system:
Apostille and consular legalization: Apostilles and consular legalization will not be required in any case, either for the instruments supporting the transfer or for the documents evidencing representation, even when executed abroad.
Certification of signatures: For private instruments, only the transferor’s signature must be certified, and, where applicable, the signature of the spouse providing consent.
Multiple recordals: Where successive transfers are executed in the same act and instrument, they may be recorded through a single application.
Effects of recordal: Recordal has declarative effect and is effective as from the filing date. All statements made have the value of an affidavit.
INPI Resolution No. 162/2026 repeals the previous regime and is currently in force.
Holders of industrial property rights with pending transfers of ownership may file their applications under the new regulation.
