Argentina Launches the Program for Transparency and Personal Data Protection in the Use of Artificial Intelligence

In a significant step toward regulating the use of Artificial Intelligence (AI), Argentina announced the creation of the Program for Transparency and Personal Data Protection in the Use of Artificial Intelligence. The initiative aims to provide guidance and establish directives for the implementation of AI technologies in Argentina, with a focus on transparency and the protection of personal data.

The program was formalized through Resolution 161/2023 of the Agency for Access to Public Information (AAIP), published in the Official Gazette on August 30, 2023. It is based on principles and recommendations issued by international organizations such as the Organisation for Economic Co-operation and Development (OECD) and the United Nations Educational, Scientific and Cultural Organization (UNESCO), which emphasize the importance of ethics, transparency, applicability, safety, and data protection in the development and use of AI systems. Additionally, it underscores the need to ensure that AI systems are robust, safe, unbiased, and reliable.

The program also addresses several key dimensions for the implementation of AI projects, including awareness and education, human oversight and decision-making, as well as responsibility and accountability. It emphasizes the importance of complying with national, regional, and international legal frameworks related to privacy and personal data protection in the context of AI.

The National Directorates for the Evaluation of Transparency Policies and for the Protection of Personal Data have been appointed to oversee the effective implementation of the program. They will carry out joint actions and establish appropriate mechanisms to monitor and assess progress.

This work will be complemented by the AI Observatory, which will conduct research, statistical analysis, and monitor advances in AI as well as the key actors involved. A Multidisciplinary Advisory Council will also be created to build consensus and help develop sector-specific policies.

Finally, the program proposes awareness campaigns and the publication of transparency criteria on the National Transparency Portal.

The creation of this program represents an important milestone in the regulation and oversight of AI in Argentina, aiming to uphold citizens’ rights and promote ethical practices in the development and use of this technology.
